Question-1: Does the phone pay attention to our conversation?

Answer- The phone does not pay attention to your conversation all the time. Yes, if you have allowed an app to microphone. Or the phone should be on voice assistants like ‘Hey Siri’, ‘OK Google’. These features focus on sounds in the background for a few seconds, but are only active when an order is given.

Question-2: Are the advertisements based on the things heard through microphone?

Answer- Most of the advertisements are based on your online activities. Such as your search history, app use, location, browsing pattern and shopping habits. Website and apps track every click and choice of you and show advertisements accordingly. For example, if you are looking for a mobile cover, advertisements associated with it may appear on many websites.

‘Showing advertising’ is a very rare way to show a microphone-based advertisement, which is possible only when an app has a microphone permission.

Question-3: What information does a phone get from us?

Answer- Our smartphone and other digital devices (such as smartwatches, laptops, smart TVs or gaming console) get a variety of information to make the user experience better and advertisers look more relevant.

Question-4:  Is all this information related to your identity?

Answer- Reliable agencies do not link this information to your direct identity (such as name or address). Instead, they turn it into unknown business information (anonymous information) to maintain your privacy and focus on advertisements.

Question-5: How will we know whether an app is listening to our conversation or not?

Answer- First, check the microphone permission of the app you are using. Most phone apps seek permission for microphone access at the time of installation, at that time we forget and allow it. Therefore, check the confidentiality policy of the apps because it explains how the app can use your information. Some apps also offer the option that you can prevent your voice from being recorded.

Question-6: How can you turn off the microphone access of any app?

Answer- You can close the microphone access of the app from the setting of your phone.

Question-7: Is this a crime?

Answer- It comes in gray zone. If you have allowed microphone access, then the app is technically under the regulations. But if recording is happening without permission, it is a violation of the law.

Question-8: What important steps can be taken to protect privacy in the online world?

Answer- It is necessary to take some easy steps to protect online privacy. First, check its privacy policy before downloading any app. Give the app only permissions that are clearly necessary, such as camera, location or microphone access. Also, give this permission only when the app does not work without it. Keep checking your mobile and social media settings from time to time so that you can know what information is visible to others.

Question-9: What does Indian law say about this?

Answer- The validity of phone data in India depends on whether the data is being collected by your consent and in the legal realm. Data in India are major laws and acts related to privacy.

Digital Personal Data Protection Act, 2023 (DPDP Act)

This is a new law, designed to protect your online information. That is, no agency can use the information given by you (such as name, mobile number, email, photo) without your permission.

Information Technology Act, 2000 (IT Act)

If an agency does not protect your personal information (such as bank information or health related information) or gives it to someone else without your permission, then legal action can be taken against it.
